REGULATIONS
„YOUNG ARTS MASTERCLASS ONLINE” REGULATIONS
§1. GENERAL PROVISIONS
1. The organizer of the “Young Arts Masterclass Online” master courses (hereinafter “YAM online”) is the “Young Arts” Foundation (hereinafter referred to as the Organizer).
2. The courses are dedicated to persons who are at least 14 years old, are students of second-degree music schools or university students who want to improve their violin and cello skills.
3. YAM online takes place from 10 to 16 August 2020.
§2. TERMS OF PARTICIPATION
1. YAM online are free courses.
2. The condition for qualifying for YAM online is completing the Application Form by 31 July 2020 and sending a link to video materials covering the performance of repertoire recorded by the candidate from the periods of classicism, romanticism and music of the 20th century, whose total length is at least 10 minutes, and does not exceed 30 minutes, video business cards or a description of artistic achievements and sending an email confirmation to hi@yamasterclass.com.
3. The video material must be of good quality so that the identity of the candidate and the convergence of the audio and video layer can be determined. Recordings should be sent as a link to the recording, e.g. on youtube, not in the form of a file.
4. The Participant will be selected on the basis of information contained in the Application Form and recording.
5. In the case of more applications, a reserve list of candidates will be created. If a candidate resigns from participation in YAM online, a candidate from the reserve list may be qualified.
6. The Organizer will select Participants from among the submitted applications that meet the YAM online criteria. The Organizer makes decisions based on a subjective assessment of the submitted application and is not obliged to justify its decision, also regarding the assignment of the Participant to the YAM online Teacher.
7. The Participant applying to YAM online or his legal guardian in the case of minors, consents to the processing of personal data by the Organizer.
§3. ORGANIZATIONAL PROVISIONS
1. As part of participation in YAM online, each Participant is guaranteed 4 online solo lessons (45 minutes each) with the assigned Teacher and classes with Trainers according to the schedule set by the Organizer.
2. The YAM online Participant is required to be punctual and follow the schedule of classes.
3. The YAM Online Participant is responsible for ensuring access to the communicator specified by the Teacher. The Organizer is not responsible for interruptions in the provision of Lessons and the lack of access to Lessons for reasons beyond the control of the Organizer.
4. If the Lesson is abbreviated or does not take place for reasons attributable to the Teacher, then the Participant will be offered a different date for providing the Lesson in full or in the appropriate part of the lesson (over 10 minutes shortened).
5. If the Lesson is abbreviated or does not take place for reasons not attributable to either the Teacher or the Organizer, the User shall not be entitled to any claims against the Teacher or the Organizer.
6. The Organizer is liable only if the Lesson does not take place for reasons attributable to the Organizer, then the Participant will be offered a different Lesson date.
7. Lessons and materials received during the Lesson are of informative and advisory nature based on the original program prepared by the Teacher. The Organizer is not responsible for the content and course of the Lesson, nor for the content of materials.
8. All forms of fixation of the Course, without the prior written consent of the Organizer, in particular recording or photographing is prohibited, with the exception of the provisions of para. 11.
9. Every YAM Participant online should be insured against medical expenses and personal accident consequences.
10. The Organizer does not provide insurance and is not responsible for any accidents, thefts or damage during the Lessons.
11. The Participant undertakes to register classes using a video recording device in a resolution not less than Full HD (1920 x 1080 pixels) and to send the recording to the Organizer no later than by the end of YAM online. Detailed instructions on how to record the lesson will be sent to the Participant at the stage of qualifying for YAM online.
§4. PHOTOGRAPHING, FILMING
1. The Organizer has the right to record classes using photo, audio-video or audio techniques within YAM online.
2. By signing the Application Form, the Participant agrees to take photos of the classes carried out as part of YAM online using photo, audio and audio-video techniques (hereinafter referred to as “recording”).
3. The consent indicated in par. 2 constitutes the granting of a license to use property copyrights to record the artistic performance of classes. Then the Participant is called the Licensor and the Organizer is the Licensee.
4. The Licensor grants the Licensee the right to use the proprietary copyrights to the recording by the right to place on the website, on a publicly accessible Internet portal, with the right to free use of the recording by an unlimited number of people, in the following fields of use:
a. recording of a musical piece performed during the course or concerts by photo, audio and audio- video technique in any format;
b. providing the recording on a publicly accessible website with the right to free use of the recording or its fragment (s) by an unlimited number of people.
5. The Licensor grants the Licensee, in the entire subject matter of the recording referred to in this paragraph of the Regulations, a license as:
a. non-exclusive license,
b. without territorial restrictions,
c. full,
d. concluded for a fixed period of 5 years,
e. with the right to sub-license for an unlimited number of entities.
6. The license includes the right to use the recording in whole or in part.
7. The Licensor undertakes to execute and grant a license free of charge in the full scope of subjects indicated in this paragraph.
8. Due to the free of charge services, the Licensor is not entitled to contractual remuneration from the Licensee.
§5. FINAL PROVISIONS
1. All issues not included in the Regulations shall be settled by the Organizer.
2. Application to participate in YAM online is tantamount to acceptance of these Regulations. In the event of failure to comply with these Regulations, the Organizer reserves the right to remove the Participant from YAM online.
3. The Organizer reserves the right to make changes to these Regulations in writing.
4. The Regulations shall enter into force on the day of commencement of recruitment by the Organizer.
